Under the Water Industry Act 1991, developers are responsible for constructing new sewers to connect their development to the public sewer network. Once the sewers are constructed, the developer can apply to the relevant water company to have the sewers "adopted" or taken over for maintenance and repair.
The purpose of a section 104 application is to transfer responsibility for the new sewers from the developer to the water company. This ensures that the sewers are properly maintained and repaired, and that they meet the necessary technical and safety standards.
To make a section 104 application, the developer must provide the water company with detailed information about the new sewers, including plans, specifications and construction details.
The water company will then review the application and may carry out inspections and tests to ensure that the new sewers meet the required standards.
If the application is approved, the water company will issue a certificate of adoption, which confirms that the new sewers have been taken over for maintenance and repair. The developer will then be relieved of their responsibility for the sewers and the water company will become responsible for their ongoing maintenance and repair.
